Welcome to Gromit! These Terms and Conditions ("Terms") govern your access to and use of the Gromit mobile application and associated services (collectively, the “App”), operated by Gromit India Technologies Pvt. Ltd. ("Gromit," "we," "us," or "our"). By using our App and services, you agree to these Terms. Please read them carefully.
You must be at least 18 years old to use the Gromit App. By registering, you represent that you are legally eligible to enter into a binding agreement and comply with these Terms.
You must create an account to access most features of the App.
You are responsible for maintaining the confidentiality of your login credentials.
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
We reserve the right to suspend or terminate your account if any information is inaccurate, misleading, or violates these Terms.
Gromit connects users with restaurants, food vendors, and delivery partners to facilitate online food ordering and delivery. We act as an intermediary platform and do not prepare, pack, or deliver the food ourselves.
Order Acceptance: All orders are subject to restaurant/vendor availability and acceptance.
Pricing: Prices listed on the App are set by vendors and may be subject to change, including applicable taxes and delivery fees.
Delivery Time: Estimated delivery times are provided for convenience and may vary due to traffic, weather, or vendor constraints.
All payments must be made through the App using accepted payment methods (UPI, cards, wallets, etc.).
Gromit uses third-party payment processors. We do not store or process card/payment details directly.
In case of a payment failure or deduction without confirmation, please contact support via the app.
User-Initiated Cancellation: Orders can only be cancelled before the vendor begins preparation. Refund eligibility depends on the stage of the order.
Vendor/Platform Cancellation: We may cancel orders due to unavailability, incorrect pricing, or technical issues. Refunds will be processed accordingly.
Refund Timeline: Refunds will be processed within 5–7 business days, depending on your payment method and provider.
You agree not to:
Use the App for unlawful, fraudulent, or abusive purposes.
Interfere with the App’s operation, security, or content.
Attempt to access accounts or data not belonging to you.
Post or transmit any defamatory, offensive, or misleading content.
Violations may lead to suspension or termination of your access to the App.
All content, branding, and software on the App are owned or licensed by Gromit. You may not copy, reproduce, distribute, or modify any part of the App without prior written consent from Gromit.
The App may contain links to third-party websites, vendors, or services. Gromit is not responsible for the content, privacy policies, or practices of any third parties.
The App and Services are provided "as is" and "as available."
We make no warranties regarding the quality, safety, or availability of food or services provided by third parties.
Gromit does not guarantee that the App will be error-free, uninterrupted, or free of viruses.
To the maximum extent permitted by law, Gromit and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from:
Your use or inability to use the App.
Any food order or delivery issues.
Errors or inaccuracies in information provided by vendors.
You agree to indemnify and hold harmless Gromit, its directors, employees, and partners from any claims, damages, or expenses arising out of:
Your violation of these Terms.
Your misuse of the App or services.
Any content you submit or actions you take while using the App.
Gromit reserves the right to suspend or terminate your access to the App at any time, without notice, for conduct that violates these Terms or is otherwise harmful to Gromit, other users, or third parties.
These Terms shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts located in West Bengal, India.
We may modify these Terms at any time. Updates will be posted on the App with the revised effective date. Continued use of the App after such changes constitutes your acceptance of the updated Terms.
